Fleur advises on competition and trade practices. She has specific expertise in access law and economic regulation in network industries, including electricity and gas, telecommunications, rail, water and aviation.

Fleur offers advice on:
  • Restrictive trade practices, including price fixing, market sharing arrangements, exclusive dealing and anti-competitive agreements.
  • Merger clearance.
  • Access to essential infrastructure under Part IIIA of the Trade Practices Act.
  • Access and economic regulation of the telecommunications industry under Parts XIB and XIC of the Trade Practices Act.
  • Energy regulation under the National Gas Access Code and the National Electricity Law and National Electricity Rules, as well as under State-based regulations.
  • State-based industry specific regimes for the economic regulation, including in particular the economic regulation of the rail and water industries.

    • Fleur has acted for both the ACCC and the NCC, as well as for corporate clients appearing before these bodies.

    Fleur provides a unique insight into the approach of competition regulators and review bodies to decision-making in competition, access and economic regulatory matters, having:
  • Worked with the Australian Competition Tribunal for six months. During this time she assisted the Tribunal in its review of the ACCC's decision not to authorise the Qantas / Air New Zealand trans-Tasman alliance.
  • Undertaken a secondment with the National Competition Council during which she drafted its Guide to Declaration under Part IIIA of the Trade Practices Act.
